Swiitch Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Swiitch hardware device and the associated mobile application (collectively, the "Services"). By purchasing, accessing, or using Swiitch, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Services.

1. Who We Are

Swiitch is operated by Beachfront Flamingo Rentals CC, trading as Swiitch, a digital wellness company domiciled in South Africa.

Swiitch creates a physical device designed to help people temporarily block distracting applications and notifications on their smartphones. Our mission is to help people reclaim control over their technology use without completely abandoning the benefits of modern smartphones.

Swiitch is currently offered to customers in South Africa only.

2. Scope of These Terms

These Terms apply when you:

  • Visit our website (getswiitch.com), interact with our social media pages, or receive communications from us ("Visitors"); and

  • Purchase, use, or interact with the Swiitch hardware device and the Swiitch mobile application ("Users").

"You" may, depending on the context, be a Visitor or a User.

3. How Swiitch Works

Swiitch operates using purely on-device logic.

  • All app blocking decisions occur on your device.

  • We do not collect or transmit data about which apps you block.

  • Your app choices and content remain entirely on your device and are protected by Apple’s Screen Time frameworks.

Swiitch can be used without an account. There is no subscription. You make a one-time hardware purchase.

The system includes:

  • Five (5) emergency unblocks when first activated; and

  • One (1) emergency unblock top-up every four (4) weeks.

If you run out, you may request additional unblocks.

Swiitch may be used by:

  • Adults managing their own device; or

  • Parents or guardians managing a child’s device.

You are responsible for ensuring that your use of the Services complies with applicable laws and parental-consent requirements.

4. Privacy

Our collection, use, storage, and disclosure of personal information is governed by our Privacy Policy, which forms part of these Terms.

Our Core Privacy Promise:

We do not collect or transmit data about the apps you block. All blocking choices remain on your device.

We may collect limited information required to:

  • Process orders;

  • Provide customer support;

  • Send service-related communications; and

  • Comply with legal obligations.

By using the Services, you acknowledge that you have read and understood our Privacy Policy.

5. Communications

By purchasing Swiitch or contacting us, you consent to receive electronic communications from us via email.

These communications may include:

  • Service notices (order confirmations, pairing guidance, security information);

  • Legal notices (updates to these Terms or our Privacy Policy);

  • Product updates and improvements;

  • Customer support responses; and

  • Optional marketing content.

You may unsubscribe from promotional emails at any time using the unsubscribe link in the message.

You cannot opt out of mandatory service or legal communications.

What this means: We’ll email you important information about your order and your device. We may also send optional product updates you can unsubscribe from.

6. Apple App Store

Your use of the Swiitch mobile application is also governed by Apple’s App Store terms.

You acknowledge that:

  • These Terms are between you and Swiitch, not Apple;

  • Apple has no responsibility for the Services;

  • Apple is a third-party beneficiary of these Terms and may enforce them.

7. Warranties, Disclaimers, And Guarantees

7.1 30-Day Money-Back Guarantee

If you are not satisfied with your Swiitch device for any reason, you may request a full refund within thirty (30) days of the delivery date. To be eligible:

  • You must contact us at hello@getswiitch.com within 30 days of delivery;

  • You must provide your order number and a brief reason for the return; and

  • You must return the device in reasonable condition, allowing for normal handling and use.

Once we receive and inspect the returned device, we will issue a full refund of the purchase price to your original payment method within a reasonable period.

This guarantee applies only to purchases made directly from us and only to customers in South Africa.

7.2 Lifetime Manufacturer Guarantee

We stand behind the quality of our hardware.

If your Swiitch device stops functioning due to a manufacturing defect or hardware failure during normal use, we will provide a replacement device at no charge.

This guarantee does not cover:

  • Damage from misuse, abuse, or accidents;

  • Normal wear and tear; or

  • Modifications to the device.

To claim a replacement:

  1. Email hello@getswiitch.com with:

    • Your order details; and

    • Evidence showing the defect and that it was not user-caused.

  2. We may provide troubleshooting steps.

  3. If approved, we will send you a replacement.

What this means: If your Swiitch breaks due to a real manufacturing fault, we’ll replace it for free.

8. Disclaimers

Except for the lifetime guarantee above, the Services are provided "as is" and "as available".

We do not guarantee that the Services will be uninterrupted, error-free, or compatible with all devices or future operating system versions.

Technology is imperfect. We will do our best to help when things go wrong, but we cannot promise perfection.

9. Limitation of Liability

Nothing in these Terms limits any rights you have under South African consumer protection law.

To the maximum extent permitted by law:

  • Swiitch will not be liable for indirect, incidental, or consequential damages;

  • Our total liability will not exceed the amount you paid for your Swiitch device.

We are not responsible for:

  • Phone software updates that affect functionality;

  • Internet or network failures;

  • Third-party app behaviour;

  • Data loss on your device;

  • Situations where access is blocked during emergencies, except through the built-in emergency features.

What this means: If something goes wrong, the most we’d owe you is what you paid for your device.

10. Indemnification

Where permitted by law, you agree to indemnify Swiitch against claims arising from:

  • Your misuse of the Services;

  • Your violation of these Terms; or

  • Your unlawful use of the device.

This does not apply where a claim arises from our own negligence or breach.

11. Dispute Resolution

These Terms are governed by the laws of South Africa.

Before starting legal action, you agree to contact us at hello@getswiitch.com and attempt to resolve the issue in good faith.

If a dispute cannot be resolved informally, either party may pursue legal remedies in the courts of South Africa.

What this means: Let’s try to sort things out first. If we can’t, South African law applies.

12. Termination

We may suspend or terminate access if you breach these Terms.

You may stop using the Services at any time by discontinuing use of the device and deleting the app.

On termination:

  • Your right to use the Services ends;

  • Certain legal sections continue to apply.

13. Third-Party Services

We are not responsible for third-party services such as:

  • The Apple App Store;

  • Payment processors; or

  • Mobile network providers.

Your relationship with those services is separate from your relationship with us.

14. General Provisions

  • These Terms and our Privacy Policy form the entire agreement.

  • If any part is unenforceable, the rest remains valid.

  • We may update these Terms by posting revised versions.

  • Continued use means acceptance.
